Class 4C and 4D catering permits in Malta 2026: cooking rules and leases

A coffee shop and a kitchen are not the same planning permission. In Malta the line is Class 4C versus Class 4D under the Development Planning (Use Classes) Order, S.L. 552.15.
Class 4C is food and drink where cooking is not allowed. Class 4D is food and drink where cooking is allowed. Signing a lease on a 4C unit and then installing a fryer is how operators pay rent on a premises they cannot lawfully use. The change of use is a full development application, not a notification, and neighbours can stop the flue.
Class 4C - no cooking
Class 4C covers establishments that serve food and drink without cooking on the premises. In practice that is coffee, wine, gelato, sandwiches assembled from prepared food, and items reheated in a microwave or a panini press.
Because there is no commercial cooking, the Planning Authority does not treat industrial extraction as part of the permitted use. That is why 4C units are easier to place in mixed streets. It is also why a 4C permit is worthless if the business plan needs a grill, a pizza oven or a deep fryer.
Ask for the permit reference and the approved drawings before you negotiate the rent. The listing word "cafe" is not a class.
Class 4D - cooking, and a different building
Class 4D is the class for food and drink where cooking takes place. Ovens, fryers, grills and open flame sit here. So does most hot takeaway, though the MTA operating licence still has to match the actual service.
Moving a unit from 4C to 4D is a material change of use. It needs a development application, a perit, and a ventilation scheme that can usually only work if a flue can reach the highest roof without creating a nuisance for the flats above and next door. OHSA still expects a commercial kitchen to be a workplace that can be assessed, not a back room with a domestic cooker.
If third parties object to the flue, the application can fail. You then have a lease and no kitchen. Make any change of use a condition precedent, with rent starting only when the permit is in hand - or take a unit that already has 4D.

Fee quotes vary by architect and by the building. Do not budget a change of use as a few hundred euros. Between the application, the perit and the extraction, operators should treat it as a capital decision and get written estimates before they sign.
What else the class does not cover
Outdoor tables on public land need a separate encroachment permit from the Lands Authority, and usually MTA clearance. The 4C or 4D permit is the inside of the building.
Grease traps can still be required by the Water Services Corporation on a 4C unit if dishwashing and dairy waste are material. Environmental Health and the MTA licence are separate from planning. A Planning Authority class does not replace them.

- Write down whether the operation cooks, and what equipment that means.
- Get the permit reference and approved drawings before heads of terms.
- If the class is wrong, have a perit say whether a 4D flue is physically possible.
- Check the local plan and likely neighbour objections, especially in mixed residential streets.
- Sign only subject to the permit you actually need, or walk away and take a unit that already has it.
Frequently asked questions
Can I cook in a Class 4C cafe if I only use a grill at lunch?
No. Cooking is the test, not the number of hours. A grill, fryer or oven wants Class 4D.
Can a landlord guarantee that a 4D upgrade will be approved?
No. Only the Planning Authority can grant the change of use. Put that risk in the lease, or do not take the unit.
Does Class 4D automatically allow takeaway?
Hot food prepared for consumption off the premises generally sits with 4D, but the MTA licence must match a takeaway operation. Do not assume the planning class covers the licence.
Is it easier to go from 4D down to 4C?
Yes. A move to the lower-impact class is usually treated as the lighter procedure. Confirm the route with the perit; do not file it as a full 4C-to-4D application in reverse.
How long does a 4C to 4D application take?
A full development application is measured in months, not days, and objections extend it. If you need to open this quarter, buy or lease a unit that already has 4D.
What happens if a 4C unit is caught cooking?
Enforcement from the Planning Authority, and the MTA or Environmental Health can close the operation. The rent does not stop.
